Resumen
As part of the obligations acquired by the Guatemalan State by ratifying the Convention on the Elimination of all forms of Discrimination against Women (CEDAW), in 2008 the Congress of the Republic of Guatemala approved the Law Against Femicide and other forms of Violence Against Women, as a mechanism to respond to the obligations acquired in CEDAW. Considering the importance of this issue, a comparative and detailed analysis of both instruments is carried out, with the purpose of determining to what extent said law complies with the obligations acquired by Guatemala in terms of prevention, care, sanction and eradication of violence against women, to guarantee their right to enjoy a life free of violence. Said analysis allowed the identification of weaknesses, limitations and omissions contained in the Law Against Femicide, so that, based on international standards on human rights, the observations of the CEDAW Committee and comparative law, a content proposal was made that should include a new Comprehensive Law for Women's Access to a Life Free of Violence, to better fulfill its objective and the obligations acquired by the Guatemalan State.
